- These terms of use ("Terms") form a legally binding agreement between you and Anuda (the
"Company," "We," "Anuda," or "Us") regarding your use of the web application/website
www.anuda.live (the "Site") or its domain, and any services offered or deemed to be
offered
by the Company, including but not limited to the delivery of content via the Site, any
mobile
or internet-connected device, or otherwise (the "Service").
- Your use of the Site, services, and tools is governed by the following Terms &
Conditions,
which are incorporated herein. By merely using the Site, you are contracting with Anuda,
the
owner of the Platform. These terms and conditions, including the policies, constitute
your
binding obligations with Anuda. Therefore, it is imperative that you familiarize
yourself with
and understand the applicability and consequential application of these terms &
conditions
before using the platform.
- When You use any services provided by Us through the Platform, including but not limited
to
Product Reviews and Seller Reviews, You will be subject to the rules, guidelines,
policies,
terms, and conditions applicable to such services, which shall be deemed to be
incorporated
into these Terms and considered as part and parcel of these Terms.
- Anuda may amend/modify these terms and conditions at any time, and such modifications
shall be effective immediately upon posting the modified terms and conditions on Anuda.
You should review the modified terms and conditions periodically to be aware of such
modifications, and your continued access or use of Anuda shall be deemed conclusive
proof
of your acceptance of these terms and conditions, as amended/modified from time to time.
Anuda reserves the right to suspend operations for support, technical upgrades,
maintenance
work, content updates, or any other reason without prior notice to any user.

Defined Terms
Unless otherwise specified, capitalized words shall have the meanings
as defined herein below:
- "Agreement" shall mean and include the completed application form, its
attachment(s), and the terms and conditions stated herein. It shall be deemed to
have been executed at Jaipur, India.
- "Company": is defined as Anuda ("the Company"), an existing Company under the
Companies Act, 1956, with its corporate office at F-37/38, Govindam Tower,
Kardhani, Kalwar Road, Jhotwara, Jaipur along with its unit for the Company's
website Anuda.live.
- "Agreement" shall mean and include the completed application form, its
attachment(s), and the terms and conditions stated herein. It shall be deemed to
have been executed at Jaipur, India.
- "Company": is defined as Anuda ("the Company"), an existing Company under the
Companies Act, 1956, with its corporate office at F-37/38, Govindam Tower,
Kardhani, Kalwar Road, Jhotwara, Jaipur along with its unit for the Company's
website Anuda.live.
- "Date of Commencement" is the date indicating the acceptance of the application
by
the User to the service.
- "Date of Termination" is the date of expiry mentioned in the notice or/and the
letter
of termination and/or the date when the services are supposed to end.
- "Anuda.live" is defined as the internet website or mobile application of the
Company at www.anuda.live.
- "My Subscriptions" contains time-to-time information and descriptions of the
Services for the User provided by the Company in writing or contained on the
website Anuda.live.
- "Registration Data" is the database of all the particulars and information
supplied by
the User on initial application and subscription, including but not limited to
the
User's name, telephone number, mailing address, account, and email address.
- "User" includes everyone who is a Subscriber/Advertiser(s) and
Browser/Visitor(s)
either as an individual or corporate subscriber for the Services and the
signatory,
whose particulars are contained in the application form and includes his
successors
and permitted assignees. "User" or "You" also includes any person who accesses
or
avails of the Services provided by the Company for the purpose of hosting,
publishing, sharing, listing, transacting, viewing, displaying, or uploading
information or views and includes other persons jointly participating in using
the
Services provided by the Company.
- Words referring to masculine include the feminine, and the singular includes
the
plural and vice versa as the context admits or requires; and Words importing
persons include individuals, bodies corporate, and unincorporated.

Term
These Terms shall continue to form a valid and binding contract between the
Parties and shall continue to be in full force and effect until the User continues
to access the
Site and avail the Services provided by the Company.

Services
The Company provides a number of real estate services through its
platform, which shall include:
- Posting User profiles or listings for the purpose of sale/rental of property and
related property services, etc.
- Finding a property through Anuda.live and its internet links.
- Placing a print advertisement in any of the group publications
through www.Anuda.live site.
- Posting advertisements on Anuda.live.
- Sending advertisements and promotional messages through emails and messages.
The Services can be purchased through various methods of payments offered. The
purchase
of Services shall be additionally governed by specific policies of sale, like
subscription fees,
payment and Refund policy, cancellation policy, etc.

Eligibility
You hereby represent and warrant to the Company that you are at least
eighteen (18) years of age or above and are competent to enter into a valid and
binding
contract, apart from being capable of entering, performing, and adhering to these
Terms &
Conditions. While individuals under the age of 18 may utilize the Service of the
site, they
shall do so only with the involvement & guidance of their parents and/or legal
guardians,
under such Parent/Legal guardian's registered account. You agree to register before
uploading
any content and/or comment and any other use or services of this site and provide
your
details including but not limited to your complete name, age, email address,
residential
address, and contact number.

Subscription Fees
- The applicable rate of the Subscription Fees for the Service provided shall be
as
mentioned on the "My Subscriptions" page or as prescribed by the Company
from time to time.
- Liability for the Subscription Fees shall accrue from the Date of Commencement.
- All individual Users who access or post information on the Site for the purpose
of
buying property shall be exempt from the application of this clause unless there
is a
change in policy at the Company's discretion.

Payment & Refund clause:
- For all services bought, 50% of the order amount would be towards the
activation/administration fees, and the remaining 50% would be refunded on a
prorata
basis in case of cancellation, considering the usage of the services. The
Customer
agrees that the refund process may take around 4 to 6 weeks after the complete
documentation has been received by the Finance team of Anuda for processing such
a refund. It is made clear that all refunds are subject to the discretion of
Anuda and
cannot be claimed as a matter of right.
- Where Subscription Fees accrue, they shall be payable at or within such time as
stated
in the invoice(s) issued by the Company to the User.
- The Subscription Fees shall be paid by the User on demand. If the user disputes
the
same for any reason whatsoever, he shall make the payment towards the
Subscription Fees accrued, subject to the Company's decision on the dispute. If
the
Company decides the dispute in the User's favor, the Company shall refund to the
User any excess amount paid by the User without any interest.
- Any delay in payment by the User of any sums due under this Agreement will give
the Company the right to charge interest on the outstanding amount from the date
the payment became due until the final payment date by the User.
- Payments made to the Company through the iOS app shall not be refundable under
any circumstances, including but not limited to the termination of this
Agreement
for whatever reason.

Owner’s Services:
The Owner’s Service once subscribed shall be non-refundable; however, the
Company may refund the amount if a property is not linked with the package
bought. In such an event, 50% of the order amount would be towards the
activation/administration fees and shall be forfeited, and the remaining 50% would
be
refunded on a pro-rata basis considering the usage of the customer. The Customer
agrees that the refund process may take around 6 to 8 weeks after the complete
documentation has been received by the Finance team of Anuda for processing such a
refund.

Charge Back Policy:
- Payment for the services offered shall be on a 100% advance basis.
- Payment for service once subscribed to by the subscriber is not refundable

Prohibited Actions
- Restriction on Unauthorized Users: The User must not permit anyone other than
the authorized individuals listed in the application to use the Service.
- Prohibition on Resale and Assignment: The User must not resell or transfer their
rights or obligations under these Terms & Conditions. Unauthorized
commercial
use of the Service is also prohibited.
- Purpose-Specific Use: The Service must be used solely for the purpose for which
it was subscribed.
- Compliance with Laws: The User must comply with all applicable Indian
laws related to the Services.
- Restrictions on Data Use: Users must not print, download, duplicate, alter, or
use any data or personal information posted by other Users, except their own
data.
- No Unlawful Use: The Service must not be used for unlawful or fraudulent
purposes.
- Offensive Content: Users must not send or receive messages that are offensive on
moral, religious, racial, or political grounds, or are abusive, obscene,
defamatory,
or threatening.
- Prohibition on Reselling Listings: Users must not resell their listings to third
parties. Services are for the User who paid the subscription.
- No Harassment or Threats: Users must not post any content that causes
threat, harassment, annoyance, anxiety, or inconvenience to others.
- Intellectual Property Infringement: Users must not infringe on the
intellectual property rights of others.
- Misuse of Information: Users must not use others' information except as
necessary to complete their transactions.
- Security Violations: Users must not attempt to breach the security of the Site
or
any connected systems.
- Introduction of Harmful Components: Users must not introduce viruses, worms,
or harmful components into the Site or network.
- Violation of Covenants: If any prohibited actions are violated, the Company can
delete related material and suspend or deactivate the User’s access, seeking
legal
remedies if necessary.
- Blacklisting and Liquidated Damages: The Company reserves the right to blacklist
Users and forfeit the unutilized subscription amount if the terms are violated.
- Lawful Purposes Only: The Services must be used for lawful purposes only,
without
violating any local, state, or central laws.
- Prohibition on Spam: All forms of spam or activities that facilitate spam are
strictly prohibited.
- Prohibition on External Spam: Users must not use other internet services to send
or post spam to drive traffic to their site.
- Prohibition on Automated Tools: Users must not use automated tools to
access, copy, or monitor any part of the Site or Content.
- Unauthorized Access: Users must not attempt unauthorized access to any part of
the Platform or connected systems.
- Prohibition on Unsolicited Advertising: Users must not solicit or advertise
services to other Users.
- Content Responsibility: The Company is not responsible for User-posted content
and disclaims liability for any resulting damages.
- Prohibited Content: Users must not host, display, upload, modify, or share any
content that: a. Belongs to someone else without rights. b. Is defamatory,
obscene,
pornographic, or invasive of privacy. c. Is harmful to children. d. Infringes on
intellectual property rights. e. Violates any law. f. Misleads or deceives. g.
Impersonates another person. h. Threatens national security or public order. i.
Contains harmful software. j. Is patently false or misleading with intent to
harass or
cause financial gain.

Use of Information/Data Supplied
- Company’s Intellectual Property Rights: All intellectual property rights related
to the Services, including User-contributed content, belong to the Company.
- Company’s Use of Data: The Company has the right to use any data supplied by
the User and share it with associates or selected third parties.
- Retention of Data: The Company retains all data supplied by the User even
after termination or suspension of the Service.
- Mobile Number Consent: By providing a mobile number, the User consents to
receiving alerts and promotional communications from the Company and its
partners.

Intellectual Property Rights
- Ownership of Marks: All logos, brands, and trademarks on Anuda are owned or
licensed by Anuda and its associates. Users have no rights to use these marks
without permission.
- Protection of Intellectual Property: Anuda respects intellectual property rights
and will terminate agreements with Users found infringing on these rights.

Confidentiality
- Definition of Confidential Information: Confidential Information includes
all proprietary information related to the Company, its services, and its users.
- Obligation of Confidentiality: Users must keep Confidential Information secret
and not disclose it to third parties without permission.
- Limited Use of Information: Users must not use, reproduce, or store
Confidential Information without the Company’s written permission.
- Return of Information: Upon request, Users must return all documents and
materials containing Confidential Information.
- Continued Confidentiality: Confidentiality obligations continue even
after termination of the Agreement.
- Access to Data: Users can access only their own data and information
on www.Anuda.live.
- Voluntary Disclosure: Users are responsible for any risks associated with
voluntarily disclosing confidential information in public areas of the site.

Variation
- Right to Amend: The Company reserves the right to amend the terms and
conditions at any time.
- Periodic Updates: Users should regularly check for updates to the Terms of Use,
as
continued use implies acceptance of changes.

Discontinuation or Modification to Services
- Right to Modify or Discontinue: The Company can add, change, or discontinue
the Service at any time, with a pro-rated refund for paid services if
applicable.
- No Liability for Changes: The Company is not liable for any consequences
resulting from the modification or discontinuation of the Service.

Maintenance
- Service Suspension for Maintenance: The Company may suspend the Service
for maintenance without notice and is not liable for any resulting loss or
damage.

Third Party Links and Resources
- No Responsibility for Third Party Content: The Company is not responsible for
the content, accuracy, or privacy practices of third-party websites linked to
from
Anuda.
- Third Party Advertising: Third-party advertisements on the Site are not
endorsements by the Company, and users engage with them at their own risk.

Termination
- Notice of Termination: Either party may terminate the Agreement with 30
days’ notice.
- Company’s Right to Immediate Termination: The Company can terminate the
Agreement immediately if the User breaches terms or if it is in the public
interest.

Liabilities upon Termination
- Subscription Fees: Users are liable for subscription fees until the termination
date.
- Payment of Dues: Amounts due to the Company upon termination must be
paid within 30 days.

Suspension of Service
- Suspension for Non-Payment: The Company may suspend the Service if the
User fails to pay dues on time.
- Termination on Suspension: Suspension for non-payment is deemed
termination, and the User remains liable for charges up to the suspension date.
- Reconnection: Service may be reconnected at the Company’s discretion
after payment of dues.

Money Back Policy
Initiating Refunds: If unsatisfied with responses to a Listing using the Money Back
Package, Users can initiate a refund process via the Feedback link on www.anuda.ive
or
by emailing info@anudarealty.com.

Violation of Terms & Conditions
- In the event of violation of Terms, the Company in its sole discretion may
pursue any
of its legal remedies, including but not limited to the immediate deletion of
any
offending material from its site, or/and cancellation of your account, and/or
the
exclusion of any person(s) who may have violated any Terms & Conditions
hereto
and seeking any injunctive relief from any court of competent jurisdiction.
Company
can also pursue violators with claims that they have violated various criminal
and/or
civil law provisions as applicable under the relevant Acts/Rules, etc. of the
land.
Anuda.live will cooperate with any investigation by any Central or/and State
or/and
local body or/and any court or/and tribunal having the competence to carry out
the
same. Such cooperation may be without notice to the User. If Company believes in
its sole discretion that any advertisement or/and services may create liability
for
- Company, Company may take any actions that it believes to be prudent or
necessary to minimize or/and eliminate its potential liability, including but
not
- limited to, the release of User information. In sum, Company reserves the right
to refuse service to anyone at any time, or/and to remove any listings or/and
any
advertisements for any reason, and without notice.
